AMC Elettronica S.r.l. (“AMC”) respects your privacy. This Privacy Policy (“Policy”) describes our practices for the collection and use of data and other information (“Information”) through the AMC Manager app, the AMC website located at www.amcelettronica.com (and any other websites designated by AMC), the mobile and other software applications provided by and on behalf of AMC, and the services provided through the AMC Virtual Private Server (VPS), website and applications (together, the AMC “Solution”). By using any part of the AMC Solution you consent to the collection and use of your Information by AMC as described in this Policy. If you have any questions or concerns regarding this Policy or the Information collection or usage practices applicable to the Solution under this Policy, please contact us at info@amcelettronica.com.   • This Policy is applicable only to Information collected through the Solution.

Scope of This Policy

The Solution enables you and other users of the Solution (“Users”) to access multiple third party devices through the Solution. When you use the Solution to access third party devices, you may share Information with those third party devices (and You consent to AMC facilitating the sharing of your Information with these devices). This Policy covers only the collection of Information by AMC through the Solution. THIS POLICY DOES NOT COVER THE COLLECTION OR USE OF ANY INFORMATION BY ANY THIRD PARTY DEVICES YOU ACCESS OR CONTROL THROUGH THE SOLUTION OR BY THE MANUFACTURERS OF THOSE DEVICES. For information about what Information may be collected through any third party device you access through the Solution or by any manufacturer of one of those devices, please contact the manufacturer of the device.

Information We Collect Through the Solution

The Information we collect about you through the Solution includes both “non-personal” and “personal” Information. We may also obtain “sensitive” personal information about you through the Solution. “Non-Personal Information” refers to information that may not by itself be reasonably associated with, linked to, or used to identify you. For example general, non user-specific Information regarding the operation and performance of the Solution. “Personal Information” refers to information that may be reasonably associated with, linked to, or used to identify you or allow you to be personally identified or contacted. For example, Personal Information may include information such as your name, email address, telephone number, address, either alone or in combination with other information.

Sources of Information

We may collect Information about you through the Solution from a variety of sources, for example: Directly from You. We may collect Information about you directly from you when you voluntarily provide it to us through the Solution. For example, through registering for an account, accessing devices through the Solution, communicating with AMC. We may use any Information you provide to us through the Solution in accordance with this Policy. Through Your Devices. We may obtain Information about you through the third party devices you access through the Solution. For example, when you connect a new device to the Solution or use the Solution to control/dialogue that/with device. We may use any Information we obtain from your devices in accordance with this Policy. From Third Parties. We may also obtain Information about you from third parties who have a right to provide us with that Information. For example, if you register for the Solution through a third-party, we may receive Information about you from that third-party. We may also obtain Information about you from third parties that have the right to provide that Information to businesses such as ours. We may use any Information about you we receive from a third party in accordance with the terms we establish with that third party. Only if we combine that Information with Information collected through the Solution will we be required to use that Information in accordance with this Policy. Through the Operation of the Solution. We may collect Information about you automatically when you interact with the Solution. For example, AMC and our third party service providers may use “cookies,” “web beacons,” and other automated tracking technology to monitor and collect Information regarding how you access, use, and interact with the Solution. “Cookies” are commonly used small files that are stored on your computer or mobile device to help identify you as a unique user of the Solution. “Web beacons” (also known as “single–pixel” or “clear” GIFs) include electronic images imbedded in the Solution that allow us to recognize when you visit that area of the Solution. We may use cookies, web beacons, and other tracking technology that expire once you close your browser or log out of the Solution or that persist and stay on your computer until you delete them. Most browsers will allow you to erase cookies from your computer or mobile device, block acceptance of cookies, or receive a warning before a cookie is stored. You may also be able to refuse certain web beacons by adjusting the settings on your browser or email software. Please refer to your browser or email software instructions or help screen to learn more about these functions. 

How We Use Information

Non-Personal Information. We may use and share the Non-Personal Information we collect through the Solution for any lawful business purpose without any duty or obligation of accounting or otherwise to you, provided that the Information remains Non-Personal Information. This will include, by way of example, developing products, services, and other offerings based on the Non-Personal Information and providing those offerings to other users and third parties. Personal Information. We may use the Personal Information we collect about you through the Solution for a variety of purposes, for example:

  • Operating the Solution and providing services through the Solution;
  • Customizing and improving the Solution for you;
  • Providing maintenance, support, and customer service for the Solution;
  • Providing notices and announcements to you relating to AMC, the Solution, or your Information;
  • Providing offers for products, services, or other offerings that we feel may be of interest to you;
  • Contacting you for direct marketing purposes;
  • Developing additional products and services; and
  • Research and analysis.

We may combine and enhance the Personal Information we collect about you through the Solution with Information we receive from third parties, provided that we use the combined Information in accordance with this Policy. We may also use the Personal Information we collect about you through the Solution to generate Non-Personal Information. When we do so, we will take reasonable measures to ensure that the Non-Personal Information is no longer personally identifiable and may not later be reasonably associated with, linked to, or used to identify you. This will include, by way of example, storing the Non-Personal Information separately from any Personal Information. Once we generate Non-Personal Information from any Personal Information, we will not later attempt to again make that information personally identifiable. However, we may combine and enhance that Non-Personal Information with other Non-Personal Information we receive or obtain third parties. You should not provide any personal information through the Solution unless you agree to the use of that information in accordance with this Policy. Sensitive Personal Information. AMC may receive Sensitive Personal Information from you through the operation of the Solution. For example, when you access a device using the Solution that records Sensitive Personal Information about you or if you voluntarily share Sensitive Personal Information in communications through the Solution. AMC will use any Sensitive Personal Information about you that we receive through the Solution solely in accordance with this Policy to enable the operation of the Solution and the exchange of that Information as directed by you. Note thought that AMC is not responsible for monitoring the Sensitive Personal Information you exchange through the Solution or for the use of that Information by other Users who receive that Information.

How We Share Information

We may share Information about you in a variety of ways, for example: Affiliates. We may share Information with companies that we own or control, that are owned or controlled by us, or that are under common ownership or control with us. Users. We may share Information with other Users when you decide to communicate with those Users (or request that we communicate on your behalf) through the Solution. This may include posting Information to areas of the Solution accessible by other Users. Devices. We may share Information with the third party devices you access and use through the Solution. This Information may also be provided to the third parties who provide those devices to you. Partners. We may share Information with partners for which we collect Information through the Solution. We will work with our partners to provide notice concerning the purpose for which any Personal Information is being collected on behalf of any partner. Service Providers. We may share Information we collect about you with third parties that help us provide any portion of the Solution. For example, we may use third parties to: (a) host, maintain, or manage the Solution; (b) collect or analyze Information; or (c) provide other services relating to the Solution. We require that these third parties agree to use the Information we share with them only to perform their obligations to us and to treat all Personal Information they receive from us in compliance with this Policy. Other Entities. We may share Information with third party companies and entities, for example so that they may develop and offer additional products and services to you that we believe will be of interest to you based on your use of the Solution. We may also share Information with law enforcement if we determine, in our sole judgment, that you have violated our agreements or policies or that the release of your Information may protect the rights, property, interests, or safety of AMC or any third party. Legal Processes. We may share Information as required by, or permitted by, law, whether in response to subpoenas, court orders, other legal processes, or as we believe is necessary to exercise our legal rights, including to defend against legal claims that have been or might be brought against us. Business Transactions. If we transfer ownership or control of any portion of AMC or the Solution to a third party, whether or not in the context of an acquisition, merger, or reorganization, we may transfer Information that third party, provided that the use of any of your Personal Information by that third party remains subject to the terms of this Policy.

Choice and Opt-Out

We provide you with a choice whether to receive certain messages through the Solution and from AMC. We also may give you the opportunity to “opt-out” of having your Personal Information shared for certain purposes permitted by this Policy. If you no longer wish to receive certain messages from AMC or to have your Personal Information shared in the manner permitted by this Policy, you may seek to opt-out of receiving those messages or having your Personal Information shared in that manner. In some cases, opting out of receiving messages or having your Personal Information shared will not affect your ability to use the Solution. However, some messages are necessary to the operation of the Solution. Likewise, some sharing of Personal Information is necessary to provide you the Solution. If you wish to opt-out of receiving these messages or of sharing your Personal Information in this manner, AMC may be required to limit or cancel your access to the Solution. All opt-out requests can be made as indicated through the Solution or contacting AMC as described above.

Security

AMC is committed to protect and secure your Personal Information. Despite our commitment, no security system can be 100% effective and we cannot guarantee that your Information will be secure in all situations. We will nonetheless take all reasonable and appropriate steps to insure the safety and security of your Personal Information. This includes using industry standard security measures to protect the loss, misuse, and unintended alteration of the Personal Information under our control. For example, our policy is that only those individuals who need your Personal Information to perform a specific job for us are granted access to that Personal Information. Likewise, all employees and contractors are kept up-to-date on our security and privacy practices. Finally, the servers that we store personally identifiable information on are kept in a secure environment.

Advertising

AMC and our third party advertisers may display advertising to you through the Solution. Our advertisers may also retarget you with advertisements about AMC while you are visiting other web sites on the Internet. In each case, the advertisements may make use of Information collected about you through the Solution to attempt to tailor the advertisements to your interests.

If you no longer wish for our advertisers to use cookies or other tracking technologies to collect Information about you through the Solution, you may seek to opt-out of having them collect your Information in this manner. You may request to opt-out of our advertiser’s use of cookies by visiting the National Advertising Initiative (NAI) at: www.networkadvertising.org/choices or the Digital Advertising Alliance (DAA) at: http://www.aboutads.info/choices/. You may also request to opt-out of Google’s use of cookies by visiting: www.google.com/ads/preferences. Additional Terms

TERMs OF USE

By purchasing, downloading, installing and using the AMC Manager application, you agree the terms and conditions of use described above.

AMC Manager application is designed for use at home: the app’ features cannot be used in the streets or on moving vehicles, as it may distract from the respect of  traffic code.

If the user is under 18, the use of AMC Manager app must be authorized by parents. 

AMC is not responsible for any damage caused by an interruption or a malfunctioning of the service, which can be blamed on the Internet provider, the mobile telecommunication company, for the cost of browsing in the absence of a data plan signed by the user with a mobile telecommunication company or, any other third party.

The AMC Manager application was developed in full compliance with and adherence to guidelines of Apple Inc. for publishing and sell on the App Store as well as in full compliance with and adherence to guidelines of Google Inc. for publishing and sell on the Google Play.

AMC makes no warranty that AMC Manager app, the services and the contents are free of computer viruses or similar contamination or destructive features. 

If the use of AMC Manager results in the need for servicing or replacing equipment or data, AMC is not responsible for those costs.

AMC Manager application was developed by Valxer di Mariani Romeo for AMC Elettronica S.r.l.

The textual contents, the graphic interface, trouble filter and the all other application's features, are protected under the legislation against property and copyright infringement.

Users are prohibited to copy, reproduce, distribute, sell, publish, distribute or otherwise exploit in other formats, or in any other form of information / content / graphic interface / logical of  the AMC's application. All uses outside of the terms above are considered infringement, then punishable as damaging to the rights of intellectual property.

Children

The Solution is not directed to children. If the user is under 18, the use of AMC Manager app must be authorized by parents.

UPDATE OR MODIFY PRIVACY POLICY AND TERMS OF USE

AMC reserves the right to update or modify the present Terms of Use and Privacy Policy at any time without prior notice. The date at the bottom of the page indicates the date on which the latest update or modification was made. 

The user is invited to consult the Terms of Use and Privacy Policy periodically: if the user continues to use the Solution after any change or revision to the Terms of Use and Privacy Policy, the user agrees upon the terms of the latest Terms of Use and Privacy Policy.

Italian law will govern any dispute which may arise; any dispute or claim will be resolved by the court in Como, Italy.
