Virtual Roads: Terms & Conditions
By purchasing, downloading, installing and using the Virtual Roads application, you agree the terms and conditions of use described below.
The training programs elaborated by Virtual Roads do not have a medical value, and/or a therapeutic/rehabilitation purpose: they cannot be used in place of any professional program or treatment.
Virtual Roads does not constitute a medical or professional advice, and shouldn’t be interpreted as such.
The training programs Virtual Roads elaborates are based on statistic data: they are not tailored on the single user, and do not constitute a professional opinion or advice.
Rovera has no responsibility for any injury and damage that may result from the implementation of the training programs: Virtual Roads is based on general fitness principles which cannot take the peculiarity of the individual case into consideration.
Rovera isn’t subject to liability for truth, accuracy, or completeness of any information conveyed to the users of Virtual Roads, or for errors, mistakes or omissions therein.
Before starting any training program with Virtual Roads, we strongly advise the user consults a physician.
A wrong or excessive physical activity may lead to health problems for which Rovera is not responsible.
If Virtual Roads is used with a biofeedback device (such as a heart rate belt), we remind the user that the data don’t have a medical value. Virtual Roads cannot be used in place of professional instruments for heart monitoring.
If the user suffers from rheumatisms or orthopaedic problems, if they were diagnosed with heart, respiratory or circulatory disease, if they underwent surgery and in general if they have any physical problem or illness, the use of Virtual Roads must be authorized by a physician.
If during the training the user experiences nausea, dizziness, pain and stiffness in the chest, irregular heart beat, vertigo, drowsiness or shortness of breath, of if they feel excessively tired, they must stop the training immediately and consult a physician.
The use of Virtual Roads is entirely at the user’s risk. Rovera has no liability for personal injury or bodily harm that may result from the use of Virtual Roads, and these terms expressly limit Rovera’s liability for any such harm.
The use of Virtual Roads does not exclude the respect of the instructions and safety guidelines of the equipment (treadmill, bike, stepper) which is used for the training.
Virtual Roads is designed for a training on home fitness equipments: the routes’ feature cannot be used in the streets or on moving vehicles, as it may distract from the respect of traffic code.
If the user is under 18, the use of Virtual Roads must be authorized by parents.
Rovera is not responsible for any damage caused by an interruption or a malfunctioning of the service, which can be blamed on the Internet provider, the mobile telecommunication company, for the cost of browsing in the absence of a data plan signed by the user with a mobile telecommunication company or, any other third party.
The Virtual Roads application was developed in full compliance with and adherence to guidelines of Apple Inc. for publishing and sell on the App Store.
Rovera makes no warranty that Virtual Roads, the services and the contents are free of computer viruses or similar contamination or destructive features.
If the use of Virtual Roads results in the need for servicing or replacing equipment or data, Rovera is not responsible for those costs.
Virtual Roads application was developed by Valxer di Mariani Romeo for Rovera.
The textual contents, the graphic interface, the elaboration of the training programs and the all other application's features, are protected under the legislation against property and copyright infringement.
Users are prohibited to copy, reproduce, distribute, sell, publish, distribute or otherwise exploit in other formats, or in any other form of information / content / graphic interface / logical of the application Virtual Roads. All uses outside of the private sector are considered infringement, then punishable as damaging to the rights of intellectual property.
Virtual Roads is designed to help the user to plan, execute and keep track of their workout, also in connection with biofeedback devices (such as heart rate belts) which can monitor the body’s response to the training.
All the data collected by Virtual Roads will be processed only for the purposes for which they were collected, and in accordance with the Italian legislation about privacy.
Virtual Roads gives the possibility of sharing some data on third party websites and third party services (Facebook, Twitter etc): the data will be shared only if the user desires so, and under their explicit consent.
Rovera will not share the user’s personal data with third parties (except in case the user gives their explicit consent to it).
The data will be handled in a way which assures safety and confidentiality. In order to do that, Rovera may use IT instruments and devices which can store, transmit and elaborate the data.
Rovera may share the user’s data with some categories of third parties:
- service providers
- bank and financial institutes for matters concerning payments; public administrations and public offices in connection with legal requirements
- legal firms
- affiliates, agents and companies Rovera works with
- third companies in order to deal with standard company management
We may disclose any information, including personal data, in case we need to comply with any applicable law, regulation, legal process or governmental request, to enforce our rights, or to protect the safety and security of Virtual Roads or other users.
